should buyer receive full refund from deceptive dealer?
Dealer waits until 2 months after buyer purchases vehicle before he discloses the fact that the vehicle is a salvaged vehicle. In this case should the dealer provide a full refund to buyer who don't want to keep vehicle?
No title work was done, and still has not been done. when we went in to pay it off he said,"oh by the way this disclosure needs to be signed so I can get your title work done." And yes it was a buy here, pay here lot. 4 x 4 auto in Cortez, Colorado.
We had motor vehicle dealer licensing here investigate this and they ruled in our favor because the law here says it must be disclosed prior to purchase, but we try to collect from the dealer and he wont pay even if we pry it from his cold, dead, grubby hands.
If the dealer truly did not disclose it had a salvaged title and lead you to believe the title was fine than you have a legal ground to push and get a refund.
Now with that being said I have to say that I find it truly hard to believe you did not know it had a salvaged title. At some point through the process of registering the vehicle or titling the vehicle you would to have had to notice that it was salvaged.
So if you truly did not know it was and the dealer lead you to believe it was a clean title then you should speak to a lawyer if the dealer is not cooperative. This does not fall under the "as is" policy. I just feel like there is more here than you are telling us. Next time run a carfax before you buy!
