Expandable Baton Holder
Is it legal use an expandable baton on your (house) property ?
I'm thinking it is legal to use whatever on your property but i just want to be absolutely sure. I recently just found out a baton is illegal to have in Texas. I am a CHL holder, but a gun is absolutely my last option. I rather use non-lethal force and a baton is the option before a gun for me if it is on my property. So is it legal to use a baton, or even whatever kind of weapons as long as its on your property ?
I think its a little dumb that you can carry a gun that can kill multiple people but yet illegal to carry a less deadly weapon....wonder how that theory works out ?
While Section 46.02 forbids the carrying of a handgun (without permit), illegal knife or "club" (which includes baton), Section 46.15 contains specific exemptions to this law if you are on your own property or property under your direct control (i.e. a business you own). Therefore it is legal to keep a baton at home for purposes of self defense. Indeed when it comes to home defense, you can use an expandable or an fixed length baton, or even just a closet rod, because there is no need to conceal it.
The ban on batons but allowing of handgun carry by permit has always struck me as terrible foolish on the part of the legislature. Not all states do this, but I'm told that the Second Amendment rights have been interpreted to apply specifically to guns, but not (yet) to other weapons, and that the lawmakers would have banned guns too if they could get away with it, so they just ban everything else they can.
